Terms and Conditions for Academic Program Code Contest ("Rules")

The Promoter of this contest is Micro Focus Limited of The Lawn, 22-30 Old Bath Road, Newbury, Berkshire RG14 1QN (the “Promoter”)

  1. By participating in the contest, an entrant accepts these Rules and all other requirements set out in any promotional material accompanying the contest. The Promoter, at its sole discretion, reserves the right to alter, amend or withdraw these Rules and all other terms and conditions and/or contests without prior notice.
  2. To enter the contest, the entrant will be required to fill out the requested personal details in the contest registration form. By entering this contest, the entrant gives the Promoter all necessary consents in relation to their personal data (e.g. entrant's name, email address, etc. as applicable) to process the data in order to operate the contest.
  3. Entry to the contest is by completing the registration form which is available at http://www.microfocus.com/codecontest (the “Website”) and making a complete submission of the following to the http://www.microfocus.com/codecontest:
    1. a) a minimum 1000 character description of a video game, which meets the requirements described below; and
    2. b) a copy of all original project and source code files for the video game (but not in .exes file format),which may also include a video snapshot of the working video game uploaded to YouTube.
  4. The video game shall be:
    1. the original creation of the entrant as either a new video game or a re-write of an existing video game;
    2. any combination of code, but a minimum of fifty percent Visual COBOL;
    3. a working video game on either Windows, Linux, Unix, .JVM or .NET platforms;
    4. developed using a licensed copy of Visual COBOL Personal Edition with a licenced copy of Microsoft Visual Studio or Eclipse available from Microsoft upon request
    5. capable of being compiled and run when tested by the Promoter' panel of judges; and
    6. free of any virus, spyware, malware; if an entrant's files are deemed to contain any malicious code the entry will not be accepted.
  5. The contest start date shall be 30 September 2013 and the closing date for entries to the contest shall be 17 December 2013 . Winners of the contest will be notified by the Promoter within six weeks of the closing date.
  6. There shall no other method of entry to the contest other than as specified in these Rules. Entries completed after the closing date will not be accepted. The Promoter does not accept responsibility for entries that are lost, delayed or not received for any reason.
  7. The contest is open to residents of all non-embargoed countries (except employees or agents of the Promoter (or their immediate family members). For our legal statement on export controls, please visit http://www.microfocus.com/export-controls
  8. Only one entry per person is permitted.
  9. All rights, title and ownership in an entry to the contest (including the project and source code files of the video game) shall transfer to the Promoter on submission by the entrant to the Promoter.
  10. The winner and runners-up will be selected by the Promoter's panel of judges (at their sole discretion) on the basis of the best entries. The decision will be made within six weeks of the closing date of the contest. The decision of the Promoter is final and no correspondence will be entered into.
  11. The prizes for the winner of the contest and the runners-up are as follows:
    1. One 1st prize of $1000 cash;
    2. One 2nd prizes of an Sony Xperia Z; and
    3. One 3rd prizes of an Apple iPad mini
    the Promoter may at its sole discretion, substitute any prize for a prize of a similar nature and/or comparable value. Runners-up are not entitled to a cash alternative to their prize and these prizes are non-refundable and non-transferable.
  12. The prize winner and runners-up will be notified by telephone or email within 48 hours of selection and will be given 48 hours from such notification to claim the prize. If a prize is not claimed within such period, the Promoter reserves the right to select an alternative winner or runner-up in their absolute discretion and the Promoters shall have no liability in respect of the entry initially selected. Any prize which is returned as undelivered will be used for another competition or sent to charity. The Promoter reserves the right to promote the details of any winner (including their contest submission) through online and written media.
  13. The winner of the prize is responsible for any applicable taxes and expenses not specified in the prize description(s) including travel expenses and such expenses shall in no circumstances be reimbursed by the Promoter.
  14. The Promoter shall not be responsible for technical errors in telecommunications networks, internet access or otherwise or events outside of its reasonable control preventing entry to any competition.
  15. By entering the contest, the entrant warrants and undertakes that the information submitted is true, accurate and complete.
  16. By entering the contest, the entrant hereby indemnifies the Promoter against any and all actions claims damages expenses or liabilities suffered or incurred directly or indirectly by Promoter in consequence of any breach or alleged breach, non-performance or non-observance by the entrant of any agreement condition obligation or warranty on the part of the entrant herein.
  17. To the fullest extent allowed by law the Promoter shall not be responsible or liable to any entrant or any third party for any loss, damage, cost and expense, howsoever arising out of or in connection with the contest and/or prize or any publicity thereof.
  18. The laws of England shall apply to these terms and conditions are any disputes will be dealt with exclusively by the English Courts.
